On Sight Audit Requirements Due to COVID-19

On March 17, 2020, the FDA issued a temporary policy for the supplier verification onsite audit requirements as outlined in FSMA (Food Safety Modernization Act).  This has been enacted to minimize disruptions in the supply-chain due to COVID-19 related travel restrictions, at a time when grocery stores nationwide are facing unprecedented demands.

Heres the issue: the Preventive Controls for Human Food (PC Human Food) rulePreventive Controls for Animal Food (PC Animal Food) rule, and Foreign Supplier Verification Programs (FSVP) rule all require that receiving facilities and importers conduct supplier verification activities based on the hazard analysis conducted as part of their written FSVP (Food Safety Plan).  In many cases, this is verification is done using onsite audits.

However, due to the travel restrictions and other recommendations associated with COVID-19, onsite audits in some cases are now impractical to carry out.

Temporary Policy:  The policy announced on March 17, 2020 states that the “FDA will temporarily not enforce the FSMA supplier verification onsite audit requirements if other appropriate supplier verification methods are used instead.” These include sampling and testing or a review of food safety records to ensure that hazards have been significantly reduced or prevented during the period when no onsite audit is possible.

“Specifically, FDA does not intend to enforce the requirement for an onsite audit in the following circumstances:

  1. A receiving facility of FSVP importer has determined that an onsite audit is the appropriate verification activity for an approved supplier, as reflected by its written food safety plan or FSVP.
  2. The supplier that is due for an onsite audit is in a region or country covered by a government travel restriction or travel advisory related to COVID-19.
  3. Because of the travel restriction or travel advisory, it is temporarily impracticable for the receiving facility or FSVP importer to conduct or obtain the onsite audit of the supplier
  4. The receiving facility or FSVP importer temporarily selects an alternative verification activity or activities, such as sampling and testing food or reviewing relevant food safety records and modifies its food safety plan or FSVP to incorporate the alternative activity or activities. The alternative verification activity or activities are designed to provide temporary assurance that the hazard requiring a supply-chain-applied-control (or, for FSVP, the hazard that is being controlled by the foreign supplier) has been significantly minimized or prevented during the period of onsite audit delay.”


FDA Notification and Timing:   The FDA will give ample timely notice before this policy is withdrawn.  The FDA also expects that receiving facilities and FSVP importers will resume onsite audits according to FSMA guidelines “within a reasonable period of time after it becomes practicable to do so and update their food safety plans and FSVP’s accordingly.”

2020年3月17日、米国の食品医薬品局(FDA)は、食品安全強化法(FSMA)で規定されたサプライヤー認証のための現場監査要件を一時的に変更すると発表しました。  新型コロナウイルス感染症に伴う渡航制限がサプライチェーンに及ぼす影響を最小限に抑えるための対応です。全米のスーパーがかつてない需要の高まりに直面している状況を受けて、この特別措置が導入されました。

現在の課題:ヒト向け食品のための予防的コントロール(PCHF)規則、動物向け食品のための予防的コントロール(PCAF)規則、外国サプライヤー認証制度(FSVP)規則はいずれも、受理施設と輸入業者に対し、サプライヤー認証活動の実施を義務付けています。この認証活動は、外国サプライヤー認証制度(食品安全性計画)の一環として、ハザード分析に則って実施しなければなりません。  多くの場合、これは外部の監査官によって行われています。

しかし、新型コロナウイルス感染症の拡大に伴う渡航制限や他の制限が出されているのを受けて、一部のケースでは現場監査の実施が現実的ではなくなりました。

 

特別措置:2020年3月17日に発表された特別措置は、次のように説明されています。「FDAは、一時的な措置として、FSMAサプライヤー認証に際して現場監査に代わる他の適切な方法が取られているのであれば、現場監査要件は義務付けない」。他の適切な方法には、サンプル抽出と試験、および食品安全性記録の確認などが含まれます。現場監査ができない期間にわたり、これらの方法を実施して、ハザードが大幅に抑制または予防されていることを確認しなければなりません。

さらに、FDAは、「特に次の状況に該当する場合は、現場監査の要件を義務付けない」と説明しています。

  1. 受理施設またはFSVPの輸入業者が、認証済みサプライヤーにとって現場監査が適切な認証活動であると判断し、それが策定済みの食品安全性計画またはFSVPに記載されている。
  2. 現場監査の対象となるサプライヤーが、新型コロナウイルス感染症に伴う渡航制限や渡航勧告の対象地域または対象国である。
  3. 渡航制限や渡航勧告があるために、サプライヤーの現場監査を実施することが、受理施設やFSVPの輸入業者にとって一時的に不可能になっている。
  4. 受理施設やFSVPの輸入業者が、サンプル抽出と試験、または関連する食品安全性記録の確認など、代替となる認証活動を一時的に選択し、食品安全性計画やFSVPを改訂して、その代替の活動を盛り込んでいる。 かつ、代替の認証活動が、現場監査の不可能な期間にわたって、サプライチェーンによるコントロールの適用を必要とするハザード(FSVPの場合は、外国サプライヤーによってコントロールされるハザード)を大幅に抑制または予防するために設計されている。


FDAの通知とタイミング:FDAは、この特別措置を撤回する際には、十分な期間の予告をするとしています。また、本来のFSMAのガイドラインに則った現場監査の再開については、「それを実施し、また食品安全性計画とFSVPを適宜改訂することが現実的になった後、合理的な期間を置いたうえで」、受理施設とFSVPの輸入業者による再開を期待すると説明しています。
