On May 25, the FDA released a new guide for smaller food facilities that are subject to the FDA’s registration requirements under the Federal Food, Drug, and Cosmetic Act (FD&C Act).
The new Small Entity Compliance Guide (SECG) details the steps food facilities must take to register with the FDA under the FD&C Act, which applies to food facilities involved in manufacturing, packing, processing, or storing food for animal or human consumption.
These new registration requirements are the result of the Food Safety Modernization Act (FSMA) that went into effect in January 2018. The guide was released in accordance with the Small Business Enforcement Fairness Act to provide additional support to small food facilities.
The SECG contains both a concise “At-a-Glance” summary as well as detailed information about registration compliance. Key information includes:
- Which types of food facilities must register
- When to register
- How to register
The SECG also explains the consequences for food facilities that do not register or fail to renew their registration, along with the circumstances under which registration can be suspended.
The requirements outlined in the SECG reflect a 2016 FDA rule requiring food facilities to permit the FDA to complete inspections, renew their registration every other year, and recognize the FDA’s ability to suspend registration. These changes are important because they allow the FDA to quickly address emergencies and complete efficient inspections.
The FDA’s Registration of Food Facilities webpage has now been updated to reflect these changes, including a feature designed to help food facilities determine if they are exempt from registration.
5月25日、米国の食品医薬品局（FDA）が、食品の製造や加工処理を手がける小規模な施設向けの新しいガイドを発表しました。連邦食品・医薬品・化粧品法（FD&C法）の下でFDAへの登録が義務付けられる施設を対象としています。
新しいガイドは「スモール・エンティティ・コンプライアンス・ガイド（SECG）」と呼ばれていて、食品施設がFD&C法に則ってFDAに登録するうえで必要となるステップを詳細に説明しています。この法律は、飼料用と食用の食品を製造、梱包、加工処理、貯蔵する施設に適用されます。
新しい登録要件は、2018年1月に食品安全強化法（FSMA）が施行された結果として導入されました。今回のガイドは、小規模事業者に対する規制の公正な適用に関する法（SBREFA）に則って小規模な食品施設に付加的なサポートを提供することを目的としています。
SECGには、登録要件を順守するための詳細な情報と簡潔な「一覧」サマリーの両方が盛り込まれていて、例えば次のようなトピックがあります。
- 登録が義務付けられる食品施設のタイプ
- 登録時期
- 登録方法
また、SECGでは、登録を怠ったり更新しなかったりした場合に何が起きるか、どのような場合に登録が留保されるかなども説明しています。
SECGに記載された要件は、2016年にFDAが打ち出した規則を反映しています。FDAの検査を許可すること、隔年で登録を更新すること、FDAの登録留保の権利を認めることなどを食品施設に義務付けた規則です。これらの変更点は、FDAが緊急事態にすばやく対応して効率良く検査を行えるようにすることから重要です。
食品施設の登録に関するFDAのウェブページ「Registration of Food Facilities」もすでに更新されいて、これらの変更点を反映した内容となっています。食品施設が登録義務を免除されるかどうかを見極めるための情報なども盛り込まれています。
