The FDA has just announced that Costco Wholesale Corporation is the first approved participant in the FDA’s VQIP – or Voluntary Qualified Importer Program. This is a voluntary fee-based program that provides importers an expedited review and import entry of both human and animal foods into the USA under FSMA, the Food Safety Modernization Act.
Once approved, participating importers like Costco, can import their products into the USA faster and with more accuracy at the point of entry thus avoiding unexpected delays and issues. Think of it like “fast tracking” your import order.
Naturally, the participating importer must meet specific eligibility criteria and pay a user fee in order to help cover the costs associated with the FDA’s administration of this program. Costco must ensure that the processing facilities of their foreign suppliers are certified through the FDA’s Accredited Third-Party Certification Program. These third parties are recognized accreditation bodies by the FDA and have the responsibility of conducting food safety audits ad issuing certifications of foreign food facilities.
Benefits of VQIP Status
- FDA will expedite import entry into the US for all foods included in an approved VQIP application.
- FDA will use its Predictive Risk-Based Evaluation for Dynamic Import Compliance Targeting (PREDICT) import screening tool to recognize shipments of food that are part of an approved VQIP application. The screening tool will be programmed to recognize and, in most cases, immediately release the shipment unless examination and sampling are necessary for public health reasons listed below.
Limited examination and sampling: FDA will limit examination and/or sampling of VQIP entries to the following situations: (1) “for cause” situations (i.e. investigation of an outbreak or illness); (2)to obtain statistically necessary risk-based microbiological samples (when building a product risk profile based on non-biased surveillance sampling); (3)to audit small percentage of import shipments covered by VQIP to verify that products declared in VQIP entry are consistent with products covered in VQIP application.
- FDA sampling at preferred locations. FDA will attempt to examine an entry covered by VQIP at the point of import entry and collect samples at the VQIP food destination or other location preferred by the VQIP Importer. If import entry to the US is denied, the FDA will assist in fulfilling an importer’s request to the U.S. Customs and Border Protection to export the refused products from the port preferred by the importer.
- Faster lab results: If collection of a sample is necessary, the FDA’s labs will prioritize the processing of the VQIP samples
- Special Help Desk: The FDA will maintain a VQIP Importers Help Desk connecting importers to FDA staff who can answer questions and help to resolve issues.

When you are ready to apply, you must begin your application by submitting a Notice of Intent to Participate and set up an account via the FDA Industry Systems website at https://www.access.fda.gov/. Once you have your account, select VQIP under the FSMA Program options which takes you to the VQIP Application Page with an option for submitting your Notice of Intent to Participate.
Note: Importers wishing to apply for the FY20 benefits period, the VQIP application portal is now open through May 31, 2020 to apply for benefits between Oct 1, 2020 and September 30, 2021.
Costco Wholesale is currently the only corporation that has been approved for this program by the FDA.

コストコホールセールが米国の「VQIP」制度の認定第1号になったことを、米国の食品医薬品局（FDA）が発表しました。VQIPとは「Voluntary Qualified Importer Program」の略で、一般に「任意適格輸入業者プログラム」と訳されています。これはFDAが運営する任意の有料制度で、この認定を取得した輸入業者は、FSMA（食品安全近代化法）で規定された食品と飼料を米国に輸入する際に、審査および輸入手続きにかかる期間を短縮することができます。
コストコのように認定を受けた輸入業者は、米国への輸入を迅速化できるだけでなく、輸入港での手続きの精度も高められるため、予期せぬ遅延や問題も回避できるようになります。輸入業務の「追い越し車線」と言えるかもしれません。当然ながら、認定を受けるには一定の規準を満たさなければならず、FDAの制度運営費用を補うための使用料も払う必要があります。コストコは、自社に商品を提供している米国外のサプライヤーの事業所がFDAの「第三者認証制度（Accredited Third-Party Certification Program）」で認証されていることを確認しなければなりません。第三者とは、FDAの指定する認証機関で、食品を取り扱う外国の事業所の食品安全性監査を実施して認証を発行する責任を負います。
VQIP認定を受けるメリット
- VQIPで申請し承認されたすべての食品に対し、迅速な輸入手続きが適用されます。
- FDAは、「ダイナミック輸入コンプライアンス・ターゲッティングのための予測的リスクベース評価（Predictive Risk-Based Evaluation for Dynamic Import Compliance Targeting）」、略して「PREDICT」と呼ばれる輸入時の審査ツールを使用して、VQIPで承認された食品の積荷を認識します。この審査ツールは、積荷を認識するようプログラムされ、ほとんどの場合は、積荷を即座に通過させます。ただし、下記のように保健衛生上の理由で調査やサンプル検査が必要となる場合は例外です。
限定的な調査およびサンプル検査：FDAは、VQIPの輸入品に対し、以下のいずれかに該当する場合のみ調査やサンプル検査を行います。（1）「正当な理由がある」状況（疫病の突発的な発生を受けた調査など）。（2）統計上の理由でリスクベースの細菌サンプル取得が必要とされる場合（商品のリスクプロフィールを作成する目的で、無作為なサンプル抽出が必要になる場合）。（3）VQIPで承認された食品のみが輸入品に含まれていることを確認するため、わずかな割合の監査を行う場合。
- 輸入業者の希望地でのサンプル検査：FDAは、VQIP対象食品の輸入港で調査を行い、サンプル検査はVQIP対象食品の最終目的地か輸入業者が希望する他の場所で実施しようとします。米国への輸入が却下された場合は、輸入業者が当該食品を希望する港湾から米国外へ輸出しなければなりません。FDAは、輸入業者がこれを税関・国境警備局に要請する過程を支援します。
- 優先的なサンプル検査：サンプル検査が必要になる場合、FDAの試験施設は、VQIPのサンプルを優先して試験します。
- 専用ヘルプデスク：FDAは、VQIP認定輸入業者のための専用ヘルプデスクを設置して、職員が問い合わせに対応し、問題解決を支援します。

申請することにした場合は、最初に「参加意向通知（Notice of Intent to Participate）」を提出することになります。これには、FDAの業者向けシステムのウェブサイト（https://www.access.fda.gov/）でアカウントを作成する必要があります。アカウントを作成後、FSMA制度のオプションでVQIPを選択すると、VQIPの申請ページが表示され、「参加意向通知」を提出するオプションが提供されます。
注：2020会計年度の申し込みを希望する場合、申請ポータルは、2020年5月31日まで利用可能です。2020会計年度の認定は、2020年10月1日から2021年9月30日まで有効です。
