The New US-Japanese Trade Agreement And Japan Tariff Schedule

On September 25, 2019, the U.S. and Japan signed a limited trade deal that will eliminate certain tariffs and allow market access to specific agricultural products, as well as industrial and digital products.  Japan is America’s third largest export market and imported more than 14.1 billion dollars in U.S. products in 2018.

From a trade perspective, this is good news for U.S. farmers, manufacturers, producers and exporters like Noon International LLC who sell thousands of containers of frozen fruits, vegetables and potatoes annually into this market. President Trump has been seeking a bilateral agreement with Japan, the world’s third largest economy, since pulling out of the Trans-Pacific Partnership trade deal after he took office in 2016.  This new deal levels the playing field, making the U.S. more competitive with products being offered from Canada, Mexico, Australia and the European Union.

Thanks to AFFI’s (American Frozen Food Institute) proactive efforts during the negotiation process, a number of frozen products were added that will either be duty free immediately upon implementation of the agreement or in a staged manner over time.   Here is a list of the products:

The following frozen products will be duty-free upon implementation:

  • Frozen Fruits: frozen strawberries, raspberries, blackberries, mulberries, loganberries, currants, and gooseberries whether or not containing added sugar.
  • Frozen Vegetables: frozen peas, beans, sweet corn, and other mixed, prepared or preserved vegetables.’’

The following frozen product will be duty-free three years after implementation beginning with a 50% tariff cut:

  • Frozen Baked Potatoes

The following frozen products that will be duty-free five years after implementation beginning with approximately a 33% tariff cut:

  • Frozen Potatoes (whole)
  • Frozen Broccoli
  • Frozen Mixed Vegetables chiefly consisting of sweet corn
  • Frozen Potatoes mashed and other potatoes prepared or preserved
  • Frozen Sweet Corn, no added sugar

The following frozen processed products will be duty-free 8 years after implementation beginning with approximately a 22% tariff cut

  • Frozen Waffles
  • Frozen Pizza

The following frozen products that will be duty-free 10 years after implementation beginning with approximately an 18% tariff cut:

  • Frozen Leguminous vegetables prepared or preserved.

Clarification on Duty-Free vs. Staged Timing/Duties

Since the Japanese Tariff Schedule can be rather confusing, many customers requested clarification on exactly which items would be duty free on implementation of the agreement and which items would fall under the staged approach.  For example, the agreement states that frozen vegetables will be duty-free upon implementation including sweet corn and beans, yet later in the agreement it states that Frozen Sweet Corn (no sugar added) will be duty free in 5 years beginning with a 33 percent tariff cut, as shown above.

We took our questions to AFFI’s Sanjay Gummalla, Ph.D and Vice-President of Scientific and Regulatory Affairs who replied as follows:

This confusion arises from the multiple sections of the tariff schedule and the manner in which these products are reflected in disparate tariff lines …I’ve attached the Japanese Tariff Schedule but hope the below tariff codes can help clarify this information: 

Note: The term EIF refers to “upon implementation” meaning that the item will be duty-free upon implementation of the agreement. Although the timeline is not yet firm for the implementation of this agreement, it is expected to be ratified by Japan in November 2019 and in effect by January 1, 2020. 

The following frozen vegetables are duty-free upon EIF into Japan:

  • Beans of 0710.22
  • Sweet corn of 0710.40
  • Certain other mixed vegetables of 0710.90.200
  • Certain other vegetables, prepared or preserved of 2004.90.299

(See Page 61 of the schedule and identify appropriate tariff line)

The following frozen vegetables will be duty-free 5 years after implementation with 1/3 tariff cut on EIF:

  • Potatoes (whole) of 0710.10
  • Broccoli of 0710.80.010
  • Mixed vegetables, chiefly consisting of sweet corn, of 0710.90.100 (“chiefly consisting” means the dominant percentage is sweet corn.)

Another section includes the below tariff lines, (See page 85 of the schedule and identify the appropriate tariff line).

The following frozen vegetables will be duty-free 5 years after implementation, with 1/3 tariff cut on EIF:

  • Potatoes mashed and other potatoes prepared or preserved, of 2004.10.2xx
  • Sweet corn, no added sugar of 2004.90.230

The following frozen vegetables will be duty-free 10 years after implementation, with 2/11 tariff cut on EIF:

  • Leguminous vegetables, prepared or preserved of 2004.90.212

You can find the Japanese Tariff Schedule HEREPlease refer to Page 61 and Page 85 for the various “staging categories” of the vegetables in question and note the different “tariff codes” that are used in each of the categories as it is these particular codes that designate whether an item is duty-free or dutiable.  For example, the tariff code for frozen sweet corn, duty free upon EIN is 0710.40, while the tariff code for sweet corn no added sugar is 2004.90.230

2019年9月25日、日本と米国が限定的な貿易協定に署名しました。関税を部分的に撤廃し、一定の農産品、工業品、およびデジタル製品に対して市場を開放する内容です。  日本は、米国にとって3番目に大きな輸出市場であり、2018年には米国から141億ドルを上回る産品を輸入しました。

貿易という点では、これは米国の農業と製造業に携わる生産者や輸出業者にとって朗報です。毎年数千点の冷凍の野菜と果物を日本へ輸出しているNoon International LLCも例外ではありません。トランプ大統領は、2017にTPP(環太平洋パートナーシップ協定)を離脱して以来、世界3位の経済大国である日本との二カ国協定を模索していました。  この新協定は、貿易環境の不均衡を是正し、米国産品の競争力をカナダやメキシコ、オーストラリア、EUからの産品と同じレベルに高めます。

この交渉の過程で米国冷凍食品協会(AFFIが積極的に動いたおかげで、新協定の発効と同時に無税になる品目、あるいは段階的に関税が撤廃される品目に、多数の冷凍食品が追加されました。   その品目のリストは以下のとおりです。

 

発効と同時に無税になる冷凍食品:

  • 冷凍果物:イチゴ、ラズベリー、ブラックベリー、マルベリー(クワの実)、ローガンベリー、カラント(スグリ)、グースベリー(加糖および無加糖)
  • 冷凍野菜:グリーンピース、サヤインゲン、スイートコーン、ミックスベジタブル、調理済みまたは保存処理済みの野菜

50%引き下げに続き、発効から3年後に無税になる冷凍食品:

  • 冷凍ベークドポテト

33%引き下げに続き、発効から5年後に無税になる冷凍食品:

  • 冷凍ジャガイモ(丸ごと)
  • 冷凍ブロッコリー
  • スイートコーンを主成分とする冷凍ミックスベジタブル
  • 冷凍マッシュポテト、調理済みまたは保存処理済みの冷凍ジャガイモ
  • 無加糖の冷凍スイートコーン

22%引き下げに続き、発効から8年後に無税になる冷凍加工食品:

  • 冷凍ワッフル
  • 冷凍ピザ

18%引き下げに続き、発効から10年後に無税になる冷凍食品:

  • 調理済みまたは保存処理済みの冷凍豆

発効と同時に無税と段階的引き下げの違い

日本の関税率表は複雑なため、具体的にどの品目が新協定の発効と同時に無税になり、どの品目が段階的に引き下げられるのかについて、多くのお客様から質問を受けてきました。  例えば、新協定では、冷凍野菜は発効と同時に無税になるとされていて、これにはスイートコーンとサヤインゲンが含まれますが、さらに読み進んでいくと、無加糖の冷凍スイートコーンは最初に33%引き下げられ、5年後に無税になると書かれています。これは上記のとおりです。

そこでこれらの質問を、AFFIの科学・規制担当責任者、サンジェイ・グマラ博士に尋ねてみたところ、次の回答をいただきました。

この混乱は、関税率表がいくつものセクションに分かれていて、これらの品目がさまざまな個所にバラバラに記載されていることから生じています。(中略)日本の関税率表を添付しましたが、以下の関税分類番号がこの情報の解明に役立てば幸いです。

注:関税率表の「実施区分」の欄に記載されている「EIF」とは、「発効と同時」、すなわち新協定が発効された時点で無税になることを意味します。新協定の発効日はまだ確定していませんが、201911月に日本で批准され、202011日に発効すると見られています。

発効と同時に無税になる冷凍野菜

  • 22に区分されるささげ属またはいんげんまめ属の豆
  • 40に区分されるスイートコーン
  • 90.200に区分されるその他の野菜を混合したもの
  • 90.299に区分される調理または保存に適する処理をしたその他の野菜

関税率表61で該当する関税の行を見つけてください)

33%引き下げに続き、発効から5年後に無税になる冷凍野菜:

  • 10に区分されるばれいしょ(丸ごと)
  • 80.010に区分されるブロッコリー
  • 90.100に区分されるスイートコーンを主成分とする野菜を混合したもの(「主成分とする」とは、最も割合の高い原材料がスイートコーンであることを意味します)

また、別のセクションに以下の関税が記載されています関税率表85ページで該当する関税の行を見つけてください)

33%引き下げに続き、発効から5年後に無税になる冷凍野菜:

  • 10.2xxに区分されるマッシュポテト、調理または保存に適する処理をしたばれいしょ
  • 90.230に区分される無加糖のスイートコーン

18%引き下げに続き、発効から10年後に無税になる冷凍野菜:

  • 90.299に区分される調理または保存に適する処理をした豆

日本の関税率表はこちらから入手できます。  61ページと85ページの「実施区分」の欄を見て、各品目に使われている関税分類番号に注意してください。この関税分類番号が、無税かどうかを判断する決め手となります。  例えば、冷凍スイートコーンの関税分類番号は0710.40で、これはEIN、すなわち発効と同時に無税になる品目ですが、無加糖のスイートコーンの関税分類番号は2004.90.230です。
